These Terms of Service (“Terms”, “Agreement”) govern the access to and use of the website yambukh.studio, as well as all associated platforms, materials, and services provided by SOLE PROPRIETOR MAKSYM YAMBYKH (“the Provider”, “we”, “our”, “us”).
By accessing or using any part of the website, purchasing design consultations or projects, or engaging with our professional services, you confirm that you have read, understood and agreed to be bound by these Terms. If you do not agree, you must refrain from using our services.
- ELIGIBILITY AND ACCEPTANCE
By using our website or services, you confirm that you are at least 18 years old and have the legal capacity to enter into binding contracts
Access to certain services may require account registration or communication via email. You agree to provide accurate information and to maintain confidentiality of any credentials provided
We reserve the right to refuse service or terminate access for any reason, including misuse, breach of these Terms, or unlawful activity - NATURE OF SERVICES
The Provider offers professional interior and design consulting services through yambukh.studio, primarily delivered online via video conferencing, digital communication tools and cloud-based file sharing systems.
In-person consultations may be arranged separately, subject to location and mutual agreement.
Services include but are not limited to
Interior design consultations and concept development
Room and apartment planning solutions
Moodboard and color palette design
3D visualization of interiors
Furniture, lighting, and materials selection
Creation of technical drawings for builders
Style and zoning guidance for spaces
Design projects for apartments and private houses
Author supervision and project coordination
All services are provided remotely to clients within the European Union and neighboring countries, unless a specific in-person arrangement is confirmed in writing. - PAYMENT TERMS
All prices are quoted in hryvnia (UAH); if payment is made in another currency, the equivalent amount will be calculated.
Payment must be made in advance, unless otherwise specified in a written agreement.
Acceptable payment methods include
Bank transfer
PayPal or other verified platforms
Invoices are issued electronically after order confirmation
In case of payment delay exceeding 30 calendar days, the service may be suspended

All materials, concepts, layouts, visualisations, drawings and documents created during the implementation of the project remain the intellectual property of the client, as this information is confidential and the transfer of intellectual property rights to the Contractor (supplier) is prohibited.
Unpaid materials, source files, drafts, and 3D models remain the exclusive property of the Provider
Any reproduction, distribution, or resale of design materials without prior written consent is strictly prohibited - CLIENT RESPONSIBILITIES
The Client agrees to
Provide accurate information, measurements, and preferences required for the project
Supply feedback and approvals within the agreed timeframe
Use the deliverables solely for the agreed purposes
Delays caused by the Client, including late communication or failure to provide required information, may extend the project deadline
The Provider shall not be responsible for project outcomes affected by incomplete or inaccurate information supplied by the Client - CANCELLATION AND REFUNDS
Due to the creative and personalized nature of design services, refunds are limited once project work has begun
Partial refunds may be approved only before delivery of the first draft or concept, subject to the amount of work already completed
Digital consultations and delivered materials are non-refundable
Clients must submit any refund request to info@yambukh.studio within 14 days of purchase. Each case will be reviewed individually according to the Return and Payment Policy - LIMITATION OF LIABILITY
The Provider delivers all services on an “as is” basis
No guarantee is made regarding color accuracy, material availability, or final visual outcome beyond the digital design stage
The Provider shall not be liable for indirect or consequential losses, including construction errors, contractor performance, or furniture availability
Liability shall not exceed the total amount paid by the Client for the relevant service - DATA PROTECTION
All data collected from Clients is handled in accordance with our Privacy Policy and the EU General Data Protection Regulation (GDPR)
We collect only necessary information for communication, invoicing, and service delivery
Clients have the right to access, correct, or delete their personal data by contacting info@yambukh.studio - GOVERNING LAW AND JURISDICTION
These Terms shall be governed by and construed in accordance with the laws of the European Union and Ukraine, to the extent applicable to cross-border service provision
Any dispute arising from these Terms shall be resolved amicably whenever possible
If unresolved, the matter shall be referred to the competent court in Poltava, Ukraine, or another jurisdiction mutually agreed in writing - MODIFICATIONS
The Provider reserves the right to update or modify these Terms at any time
Updated versions will be published on yambukh.studio with the date of revision
