This End User Licence Agreement (“Agreement”) is a legal contract between SOLE PROPRIETOR MAKSYM YAMBYKH (“the Licensor”, “we”, “our”, “us”) and any individual or organisation (“the User”, “you”, “your”) who accesses, downloads, receives, or otherwise uses design projects, visual materials, 3D models, or digital content created and distributed through yambukh.studio.
By using, receiving, or viewing any materials or deliverables provided by the Licensor, you agree to comply with this Agreement. If you do not agree, you must not use, reproduce, or distribute any of the materials provided.
- PURPOSE OF THE LICENCE
This Agreement defines the rights granted to you for the use of design materials and digital deliverables provided by SOLE PROPRIETOR MAKSYM YAMBYKH.
All works remain protected under international copyright and intellectual property laws.
The licence is limited, non-exclusive, non-transferable, non-sublicensable, and revocable. - SCOPE OF LICENCE
Upon full payment for the ordered service or project, you are granted the right to use the final deliverables for the intended and agreed purpose, including
Interior decoration and visualisation of the specified property
Personal reference or presentation materials
Non-commercial sharing of completed designs (for example, portfolio display or social media post with credit)
Any use outside this scope requires prior written consent from the Licensor. - RESTRICTIONS
You agree that you shall not
Reproduce, resell, or redistribute the design materials or 3D assets to third parties
Modify, edit, or alter files in a way that misrepresents authorship
Use the materials for automated or AI-based content generation
Upload or share the design materials on public marketplaces or digital libraries
Claim ownership or remove the author’s name, watermark, or copyright notice
Use the materials in any way that infringes upon third-party rights or applicable law
Violation of these restrictions results in immediate termination of the licence and may lead to civil or criminal liability. - INTELLECTUAL PROPERTY RIGHTS
All rights, title, and interest in and to the design materials, concepts, 3D models, renderings, drawings, documents, and associated files remain the exclusive property of SOLE PROPRIETOR MAKSYM YAMBYKH until full payment is received.
Upon payment, you are licensed to use the final deliverables for the purposes agreed in your project contract or correspondence.
Source files, layered documents, templates, and other production assets remain the property of the Licensor unless explicitly transferred in writing. - DELIVERY AND DIGITAL ACCESS
All licensed materials are delivered digitally via secure download links, email, or cloud storage.
Delivery is considered complete once the digital files are made available to the User.
Access links are personal and must not be shared with unauthorised parties. - UPDATES AND REVISIONS
Any revisions or updates to the design deliverables are governed by the terms of the client’s agreement.
Unless otherwise stated, the Licensor is not obligated to provide future updates or modifications after project completion. - USER DATA AND PRIVACY
The use of yambukh.studio and any related communication is subject to our Privacy Policy.
We process personal data in accordance with the General Data Protection Regulation (GDPR) and store it securely for project management and communication purposes only.
No personal data is shared with third parties without your explicit consent, except where required by law. - TERMINATION OF LICENCE
This licence remains effective until terminated.
The Licensor may terminate it immediately if you violate any provision of this Agreement.
Upon termination, you must cease using all design materials, delete all copies, and destroy all related files.
Termination does not affect the Licensor’s right to claim payment or damages for prior use or breach. - DISCLAIMER OF WARRANTIES
All materials and design deliverables are provided “as is”.
We make no warranty regarding
Compatibility with specific construction methods or hardware
Absolute accuracy of dimensions, colors, or materials
Uninterrupted digital delivery or availability
To the extent permitted by law, the Licensor disclaims all liability for indirect or consequential losses resulting from use or inability to use the provided materials. - LIMITATION OF LIABILITY
In no event shall the Licensor’s total liability exceed the total amount paid by the User for the corresponding design service.
This limitation applies to all claims, including negligence, contract, or other causes of action.
Nothing in this Agreement limits or excludes liability for fraud, wilful misconduct, or any matter that cannot be lawfully excluded. - EXPORT CONTROL AND INTERNATIONAL USE
You agree to comply with all applicable export control and trade regulations.
Our digital materials may not be distributed in countries under embargo or where such use would violate international law. - GOVERNING LAW AND DISPUTE RESOLUTION
This Agreement shall be governed by and interpreted in accordance with the laws of Ukraine and relevant European Union legislation.
Any dispute arising from this Agreement shall be resolved amicably whenever possible.
If unresolved, disputes shall be subject to the jurisdiction of the competent courts of Poltava, Ukraine. - MODIFICATIONS TO THIS AGREEMENT
The Licensor reserves the right to update or modify this Agreement at any time.
The latest version will be published on yambukh.studio and becomes effective immediately upon posting.
